1. Agreement to these terms

These Terms of Use govern your use of switchbacklabs.dev and software products made available by Switchback Labs, Ltd. By using a Switchback Labs website, application, or service, you agree to these terms and any product-specific terms presented to you.

2. Our products

Switchback Labs builds focused software products, including Beer On Me and TimeFit. Features, availability, pricing, and supported locations may change as products develop. Product-specific terms shown in an application or checkout flow are part of these Terms.

3. Eligibility and lawful use

You must use our products lawfully and provide accurate information. You may not misuse a service, interfere with its operation, attempt unauthorized access, use it to commit fraud, or violate the rights of others.

If Beer On Me offers alcohol-related gifting, purchase, or redemption features, those features may be used only by people who meet the legal drinking-age requirements applicable to them. Merchants may require identification and may refuse service when required by law or merchant policy.

4. Accounts

You are responsible for activity under your account and for maintaining the confidentiality of account credentials. Notify us promptly if you believe an account has been accessed without authorization.

5. Prices, payments, and taxes

When a product is offered for purchase, the price and material purchase terms will be displayed before checkout. Payments may be processed through third-party payment processors. You authorize the applicable charges when you complete a purchase. You are responsible for applicable taxes unless the checkout states otherwise.

6. Refunds and cancellations

Purchases are subject to our Payments & Refunds Policy and to any product-specific terms shown at checkout. Subscription products, if offered, may be canceled before the next renewal to prevent future charges.

7. Promotions

If we offer a promotion, discount, referral program, or limited-time offer, any additional eligibility, expiration, redemption, and other material terms will be displayed with that promotion. Promotional terms supplement these Terms.

8. Third-party services and merchants

Our products may interact with third-party services or merchants. Those third parties may have their own terms, privacy practices, eligibility requirements, fulfillment obligations, and policies. Switchback Labs is not responsible for third-party systems or services outside our control.

9. Intellectual property

The Switchback Labs name, logos, software, interfaces, graphics, and other original content are owned by Switchback Labs or its licensors and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of our intellectual property to you.

10. Disclaimers

Our services are provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee uninterrupted availability or that every feature will be available in every location.

11. Limitation of liability

To the maximum extent permitted by law, Switchback Labs will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the services. Nothing in these Terms limits liability that cannot legally be limited.

12. Governing law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
